المسؤولية الادارية على الاعمال المشروعة

Abstract

ان المسؤولية الادارية كالتزام نهائي للإدارة بالتعويض عن الاضرار التي تصيب الافراد جراء الاعمال المادية و القانونية للإدارة , تعد عنصرا هاما في القانون و القضاء الاداريين .فقد تطورت هذه المسؤولية عبر مرحلتين هامتين هما مرحلة عدم مسؤولية الدولة و مرحلة اقرار المسؤولية الادارية خاصة مع صدور قرار بلانكو الشهير . كما تقوم على اساس الخطأ و بدونه فهذه الاخيرة تقوم على اساس المخاطر و على اساس الاخلال بمبدأ المساواة امام الاعباء العامة حيث تقوم هذه المسؤولية على ركن الضرر و العلاقة السببية الت تنتفي في حالات معينة . و منه يحق للضحية رفع دعوى المسؤولية الادارية حسب موضوع نشاط الادارة في دعوى التعويض امام القضاء الاداري بشروط تميزها في ما يتعلق بالميعاد و تمديده

The administrative responsibility as a final obligation of the administration to compensate for the damages that afflict individuals as a result of the material and legal actions of the administration, is an important element in the administrative law and judiciary. This responsibility has developed through two important stages: the stage of non-responsibility of the state and the stage of approving administrative responsibility, especially with the issuance of the Blanco decision the famous. It is also based on error and without it, the latter is based on risks and on the basis of breaching the principle of equality before public burdens, where this responsibility is based on the element of damage and the causal relationship that is negated in certain cases. Hence, the victim has the right to file an administrative liability lawsuit according to the subject matter of the administration’s activity in the compensation lawsuit before the administrative court on terms that distinguish them with regard to the deadline and its extension
