Abstract

يعد الضبط الاداري في مجال المحافظة على الطابع العمراني المدينة من الأهداف الحديثة للضبط الإداري، حيث ارتبط ظهوره بتوسع مدلول النظام العام من مفهومه التقليدي إلى مفهوم حديث نتج عن تطور الدولة وذلك من خلال توسع أوجه تدخلها في مختلف الجوانب الاقتصادية والاجتماعية والثقافية، وتعد المدينة ذلك الوسط الذي يتجمع فيه الأفراد بشكل متقارب يؤدي إلى تكوين نسيج عمراني يضم مرافق وبنايات ، ما يستوجب سن قواعد وضوابط للحد من بعض سلوكيات الأفراد داخل هذه الانسجة العمرانية، وتحقيق التوازنات بين مختلف الأنشطة الاجتماعية بهدف الحفاظ على النظام العام العمراني. ومن هنا كان دور سلطات الضبط الإداري يتمثل في الرقابة على عمليات التهيئة والتعمير باستعمال أداوت التعمير وعن طريق الرخص والشهادات العمرانية، كما أنه وحفاظا على مبدأ المشروعية وضمانا لعدم تعسف سلطات الضبط أخضع المشرع هذه التدابير الضبطية لرقابة القضاء.
