Abstract: تعتبر الجزائر من الدول التي انتشرت فيها ظاهرة الفساد بشكل كبير وواسع أنطاق والتي لها أثار خطيرة على الدولة والمجتمع ،حيث صادقت الجزائر في 2004 على اتفاقية الأمم المتحدة لمكافحة الفساد بتحفظ ،وقد عملت الدولة الجزائرية منذ ذالك اليوم على وضع آليات قانونية ومؤسسات من اجل الحد من هذه الظاهرة. وقد سارعت الجزائر بعد ذالك إلى وضع هيئات خاصة بمكافحة الفساد ،وهي الهيئة الوطنية لشفافية و مكافحة الفساد وكذالك مجلس المحاسبة و قد استحدث المشرع الجزائري قوانين بهذا الصدد من اجل الحد والوقاية من الفساد من خلال تنظيمها في قانون خاص بدل من قانون العقوبات، حيث أن هذه الهيئات مخولة بمراقبة ومتابعة أشكال الفساد وإحالتها على القضاء.
