إعــــــــادة التوازن المـــــــالي في عقد البـــــــــــوت

Abstract

أفرز الواقع الاقتصادي والقانون نوع جديد من العقود أصبح شائعا في الوقت الحاضر تسمى بعقود البوت "نظام البناء والتشغيل ونقل الملكية" وتتضمن بعض الأنواع المتشابهة الأخرى وبصورة عامة هذه العقود مهمة جدا في الدول التي تتجه نحو تحويل اقتصادها إلى الاقتصاد الحر وفي الدول التي تسعى إلى التطور ولا تملك ميزانية كاملة ويكون الاعتماد في هذا النوع من العقود على القطاع الخاص الخارجي أو الداخلي، ومن خلال دراستنا السابقة وجدنا أن التوازن المالي لهذا العقد الإداري أصبح اليوم يشكل نظرية مستقلة وهامة، والأخير يستمد أصوله من الأحكام التي كان يتواتر عليها القضاء الإداري، وكذلك النصوص القانونية التي كانت ضمن هذا الموضوع، حيث أن الفقه الإداري اجتهد في تحليلها وتفصيلها وكذلك إعطائها الأساس القانوني.

The economic and legal reality has produced a new type of contracts that has become common nowadays, they are called B.O.T contracts, which stands for Build-Operate-Transfer contracts, these contracts include some other similar types as well, generally speaking, these contracts are very important in countries that are moving towards transforming their economies into free markets, as well as in countries that are seeking development but do not have a full budget, in this type of contracts, reliance is placed on the private sector, either domestic or foreign, through our previous study, we have found that the financial equilibrium of this administrative contract has now become an independent and important theory, it is derived from the provisions that administrative jurisdiction has repeatedly upheld, as well as the legal texts that were included in this subject, administrative jurisprudence has made efforts to analyze and detail these provisions, and also to give them a legal foundation.
