التنظيــم القــانوني لحـرية الإعـلام السمعـي البصــري فــي التشريـــع الجـــزائري

Abstract

عرف القطاع السمعي البصري في الجزائر تطورا مصاحباً لمختلف التحولات السياسية، الاقتصادية والاجتماعية التي عرفها البلد، مما طور الجانب القانوني الخاص به، فجاء الحديث عن قانون 1982 الذي يتبنى الاشتراكية، ومن ثم الانتقال إلى قانوني 1990 و2012 الذين يدعمون حرية التعبير، غير أن بفعل التطورات المتسارعة في الساحة الإعلامية وبروز القنوات الخاصة نص المشرع على أول تنظيم خاص بالسمعي البصري وهو قانون 2014، والذي كان هدف دراستنا وعينة تحليلنا وتوصلنا إلى أن النص القانوني حدد مجموع الضوابط التي تحكم وتقيد الانفتاح والاستثمار الخاص بالإضافة إلى تحديد صلاحيات سلطة الضبط وإشكالية التعيين وتفعيل العقوبات الإدارية والجزائية في حال تخطي الضوابط المنصوص عليها.

The audiovisual sector in Algeria has developed in parallel with the various political, economic and social transformations occurred in thecountry, therefors, its own legal aspect has been developed. Accordingly, the law of 1990 and 2012 bearing freedom of speech have been discussed. However, it is only in 2014 thanks to the impetuous development of the media land scape and the emergence of private channels- that the legislator introduced first regulation devoted to the audivisuel sector. This is the aim of our study and the sample under analysis. Is resulted in the fact that the legal text not only fixed a set of regulations that govern and restrict both openess and private investment, but also determined there gulatory authority’s powers, as well as settling the problematic of designating and activating administrative and penal sanctions in caseof breaching the aforesaid laws.
