قراءة شرعية على نظرية القانون الطبيعي

Abstract

من خلال الدراسة التي قمنا بها فيما يخص النظرية الشرعية للقانون الطبيعي والشريعة الاسلامية تم التوصل إلى النقاط الخاصة بدراسة القانون الطبيعي وتبيين حقوق الانسان اتجاه القانون من خلال الاستناد لنظرية القانون الطبيعي ،كما أن للفرد حقوقا مستمدة من ذاته باعتباره انسانا ولدت معه ، وبالتالي فليس القانون هو أساس الحق بل الحق هو اساس القانون وليس للقانون وظيفة إلا حماية هذا الحق

Through the study that we conducted with regard to the legal theory of natural law and Islamic law, the points related to the study of natural law and the clarification of human rights towards the law were reached through reliance on the theory of natural law, and the individual has rights derived from himself as a human being born with him, and therefore the law is not the same The basis of the right, rather the right is the basis of the law, and the law has no function except to protect this right
