حجية التوقيع الالكتروني في التجارة الالكترونية في القانون الجزائري

Abstract

تعرضنا من خلال دراستنا لمفهوم التوقيع الالكتروني من خلا التطرق إلى تعريفاته وخصائصه وكدا تطبيقاته لأخد نظرة شاملة على كيانه باختلاف ماينظر إليه سواء حسب وظيفته أو تطبيقاته أو الرسائل التي يتم بها ، وباعتبار أن البطاقات البلاستكية وسندات الشحن الالكترونية هي وسائل تدعم التجارة الالكترونية وتساهم بالتطور الاقتصادي ، لدالك تطرقنا من خلال دراستنا إلى فهم مضمون وكيفية التوقيع فيها سواء بالرقم السري أو إدخال شفرة أو حتى بالضغط عل زر الموافقة للإبرام المعاملة . كما يعتبر التوقيع الإلكتروني من أحدث المواضيع القانونية التي طرقت باب المشرع الجزائري بإصداره القانون15/04المحدد للقواعد العامة المتعلقة بالتوقيع والتصديق الإلكترونين ، فقد أحدث به نقلة توعية في مجال الإثبات الإلكتروني للمعاملات،محددا من خلاله الشروط القانونية لإضفاء الحجية على التوقيع الإلكتروني بالإضافة إلى أهم المصطلحات التي يستند عليها ، حيث أوجبت شروط لإضفاء الحجية عليه ، وتحديد سلطات للتصديق الالكتروني والتي تهدف إلى منح التراخيص للقيام بمهمة التصديق إلى مؤيدي خدمات التصديق والعمل على ترقية إستعمال التوقيع والتصديق الالكترونيين وضمان موثوقية إستعمالهما .

Through our study, we were exposed to the concept of electronic signature by addressing its definitions, characteristics, and applications to take a comprehensive view of its entity according to what is seen in it, whether according to its function, applications, or messages that are carried out, and considering that plastic cards and electronic bills of lading are means that support electronic commerce and contribute to economic development. Therefore, through our study, we touched on understanding the content and how to sign it, whether by using the password, entering a code, or even by pressing the approval button to conclude the transaction. The electronic signature is also considered one of the latest legal topics that knocked on the door The Algerian legislator issued Law 04/15, which specified the general rules related to signature And electronic ratification, as it brought about a shift in awareness in the field of electronic proof of transactions, specifying through it the legal conditions for giving authenticity to the electronic signature in addition to the most important terms on which it is based, as it necessitated conditions to give it authenticity, and defining authorities for electronic certification that aim to grant licenses to carry out a task Ratification to supporters of authentication services and work to promote the use of electronic signature and authentication and ensure the reliability of their use.
