العمل النقابي في الجزائر بين المشروعية والنزاهة وأثره في تحقيق المكاسب الاجتماعية للعمال

Abstract

يتمثل موضوع هذا البحث في محاولة لتحديد العمل النقابي في الجزائر بين المشروعية والنزاهة وأثره في تحقيق المكاسب الاجتماعية للعمال،دراسة على ضوء قانون رقم 22-06 مؤرخ في 24 رمضان عام 1443 الموافق 25 أبريل سنة 2022 ،وهو معدل ومتمم للقانون رقم 90-14 المؤرخ في 09 ذي القعدة عام 1410 الموافق لـ 02 يونيو 1990.جاء هذا الموضوع من الأهمية التي تتميز بها فئة العمال ودورها ووظيفتها وموقعها، ونظرا للتطور الخدمات وتطور احتياجات المجتمع كان لزاما عليهم التكتل والاستناد على تنظيمات تسهر على تحقيق متطلباتهم وحقوقهم المشروعة وفقا لما يقتضيه القانون. فالنقابة العمالية احد التنظيمات التي تهدف إلى تحسين ظروف العمل والدفاع عن حقوقهم، وبصدور القانون المذكور أعلاه، أردنا معرفةإلى أي مدى سيضمن هذا القانون الجديد تحقيق المكاسب الاجتماعية للعمال.

The topic of this research is an attempt to define trade union work in Algeria between legality and integrity and its impact on the social gains of workers. The study is in the light of Act No. 22-06 of 24 Ramadan of 1443, corresponding to 25 April 2022, which is amended and supplemented by Act No. 90-14 of 09 Dhu Qaida of 1410, corresponding to 02 June 1990. This topic is of particular importance to the group of workers, its role, function and location. In view of the evolution of services and the development of society's needs, they must assemble and rely on organizations that ensure the realization of their legitimate requirements and rights as required by law. The trade union is one of the organizations that aims to improve working conditions and defend their rights. With the promulgation of the above-mentioned law, we wanted to know to what extent this new law will ensure the realization of workers' social gains.
