بيع ملك الغير في القانون المدني الجزائري

Abstract

يتمحور موضوع بحثنا هذا حول بيع ملك الغير في القانون المدني الجزائري دراسة مقارنة بالفقه الإسلامي، حيث نتناول فيه تحديد ماهيته ونطاقه وطبيعته والقواعد المنظمة لأحكام بيع ملك الغير فيما بين المتعاقدين والغير في القانون المدني الجزائري و الفقه الإسلامي، إذ أن ذلك يحدث كثيرا في الواقع العملي للناس ، ومن ثم نحاول تقديم أثار و تطبيقات لكثير من الوقائع المتكررة في الحياة الواقعية مع بيان موقف الفقه الإسلامي منها، و الختام ببعض النتائج و التوصيات .

The subject of our research is on the sale of the property of others in a comparative study between civil laws and Islamic jurisprudence accordring of his definition, field of application, nature and rules regulating the provisions of the sale of the property of others between the contracting parties and third parties in the Algerian civil law and Islamic jurisprudence. This phenomena is an local and well large practice. Finaly, we will present the effects and applications of many recurring facts in real life, with a statement of the position of Islamic jurisprudence on them, and to conclude with some results and recommendations.
