رفع الحرج في القرآن الكريم

Abstract

خلق االله سبحانه وتعالى الخلق وكلفهم بتكاليف، فمن التزمها كان مطيعا ومن انزاح عنها وخالفها كان عاصيا واستحق العقاب والناظر في هذه التكاليف والأوامر يرى أنها لم تنشئ عبثا ولا فيما يخرج عن قدرة المكلف فالشارع لم يكلفنا بما ليس في مقدورنا فهذه التكاليف كلها من ورائها مقاصد وحكم ترجع على المكلف بالنفع. الشريعة عدل كلها ورحمة كلها ومصالح كلها وحكمة كلها فكل مسألة خرجت من العدل إلى الجور ،وعن الرحمة إلى ضدها ،وعن المصلحة إلى المفسدة ،وعن الحكمة إلى العبث فليست من الشريعة وإن دخلت فيها بالتأويل. فالشريعة عدل االله بين عباده .ورحمته بين خلقه. وقد تناول هذا البحث موضوع رفع الحرج في القرآن من حيث مفهوم رفع الحرج و أدلته وأسبابه ممثلا لذلك بتطبيقات في العبادات (الصلاة و الصيام) وفي الحدود والجنايات ب(السرقة و الزنا و شرب الخمر). وقد خلصت إلى أن القرآن هو أفضل الكتب السماوية وأكملها على الأطلاق حيث يرعي حال المكلفين في كل زمان ومكان وحسب قدرة كل مكلف وقد برزت هذه الصفة وتجلت في جميع متطلبات الحياة البشرية

God Almighty created the creatures and assigned them duties, so whoever adhered to them was obedient, and whoever turned away from them and went against them was disobedient and deserved punishment. Returns to the beneficiary. Sharia is all justice and all mercy, all interests and all wisdom. Every issue that departs from justice to injustice, from mercy to its opposite, from benefit to evil, and from wisdom to tampering, is not from the law even if it is entered into by interpretation. Sharia is God’s justice among His servants, and His mercy among His creatures. This research dealt with the issue of removing embarrassment in the Qur’an in terms of the concept of removing embarrassment and its evidence and causes, as represented by applications in worship (prayer and fasting) and in the punishments and crimes (theft, adultery and drinking alcohol.( I have concluded that the Qur’an is the best and most complete of the heavenly books, as it takes care of the condition of the obligated in every time and place, according to the ability of each obligated one. This characteristic has emerged and manifested itself in all the requirements of human life
