السياسة العقابية لدى المدرسة التوفيقية

Abstract

السياسة العقابية ذلك الاسلوب او المنهج الذي تتخذه دولة ما الحد من الجرائم اذ تعد المدرسة التوفيقية من أهم المدارس العقابية فقد جمعت بين أفكار المدارس المختلفة فكانت مدرسة وسطية. إن ما يجعل هذه المدرسة مميزة عن مختلف مدارس السياسة العقابية اعتمادها على فكره التفريد العقابي التي تفضي مراعاة شخصية المجرم. بالرغم من الانتقادات الموجهة لهذه المدرسة إلا أن سياستها القائمة على الجمع بين افكار المدارس المختلفة والتوفيق بين العقوبات والتدابير الاحترازية ظلت ناجعة للحد من ظاهرة الاجرام الى مدا بعيد. إن اهتمام الشريعة الاسلامية بالسياسة العقابية لا يقل عن اهتمام المدارس الوضعية وهذا نظرا للهدف المشترك بينهما فكلاهما يسعى الى الحد من الظاهرة الاجرام وكذا معاقبة المجرم بالعقوبة التي تحقق كل من الردع والإصلاح له.

The punitive policy is that approach or curriculum that a state takes to reduce crimes because the school of compromise is one of the most important penal schools. It combined the ideas of different schools and it was a middle school. What makes this school distinct from the various penal policy schools is its dependence on the idea of punitive uniqueness that leads to the consideration of the criminal's personality. Despite criticisms of this school, its policy of combining the ideas of various schools and reconciling sanctions and precautionary measures has been effective to reduce the phenomenon of criminality to a long way. The Islamic Shari 'a's interest in punitive policy is no less than that of spatial schools, both of which seek to reduce the phenomenon of criminality and to punish the offender with punishment for both deterrence and reform
