واقع وآفاق الديمقراطية التشاركية في التشريع الجزائري

Abstract

الديمقراطية التشاركية هي الشكل الجديد الحديث للعملية الديمقراطية التي طبق في العديد من الدول ومنها الجزائر، وهي تتجاوز المقاربات التقليدية، وهي ضرورة ملحة فرضتها الحاجة الماسة إليها، إذ من خلالها يمكن إعادة جمع النسق الاجتماعي، وذلك من خلال تجسيد المشاركة الفعلية والهادفة لمختلف أطياف المجتمع ( المجتمع المدني، الموطن ، القطاع الخاص)، بإدماجهم في استساغ القرارات التي تخصهم من خلال توظيف جملة من الوسائل والآليات كالحق في الإعلام، وحق الاطلاع ،والمشاورة.......الخ فيما يعينهم على المستوى المحلى والجهوى دون إقصاء، ولكن بطريقة منظمة ومهيكلة، إلا أننا في الواقع نجد الكثير من التحديات والعراقيل التي تعيق تجسيدها. والجزائر من الدول التي تبنت هذه المقاربة في إطار إصلاح المنظومة القانونية، إلا أنه في واقع التجربة الجزائرية أصبحت الديمقراطية التشاركية مجرد شعار للخطاب السياسي يرفع مع كل استحقاق انتخابي وينتهي بانتهائه، وهذا راجع لجملة من الصعوبات منها صعوبة القانون وغموض التكريس الدستوري لحق المشاركة وغموض مبدأ المشاركة في النصوص التشريعية.
