سلطات الوالي في الضبط الإداري

Abstract

من خلال هذه الدراسة خلصنا إلى أن الوالي يتمتع في الأحوال والظروف العادية بسلطات واسعة في مجال الضبط الإداري ، بدت أكثر اتساعا خلال فترة وباء كورونا – كوفيد 19 – بوصفه ظرفا استثنائيا غير عاديا وغير متوقعا ، فبالإضافة لوسائل الضبط التي يوظفها الوالي في الأحوال العادية ،كلوائح الضبط بمختلف أنواعها ( الحظر ، الترخيص ، الاخطار المسبق ، وتنظيم النشاط ...... ) ، والآليات الأخرى ، فقد مكنت النصوص القانونية المنظمة لفترة وباء كورونا ، الوالي من تفعيل إجراءات احترازية وقائية جديدة أقرتها تلك النصوص أكثر حدا وتقييدا للحريات ، تمثلت في فرض تدابير التباعد الإجتماعي بما تضمنته من إجراءات تعليق وتنظيم الأنشطة والغلق وتسخير للأفراد و المنشأت وإقرار الحجر المنزلي الشامل أو الجزئي وغيرها . وترك للوالي سلطة تقديرية واسعة لاتخاذ أي تدابير يراها ضرورية للحد من انتشار الوباء ، حتى وإن تخطى حدود المشروعية العادية لاعتبارات حفظ النظام وحماية المصلحة العامة ، غير أن تلك الأعمال الصادرة عن الوالي خلال هذه الفترة تظل تخضع للرقابة السياسية من جهة ، و القضائية من جهة أخرى ، كضمانة لحماية الحقوق والحريات .

Through this study, we concluded that the governor, in normal circumstances and conditions, enjoys wide powers in the field of administrative control, which seemed to be more extensive during the period of the Corona epidemic - Covid 19 - as an exceptional, unusual and unexpected circumstance, in addition to the means of control that the governor employs in normal circumstances, as regulations Control of all kinds (ban, licensing, prior notification, and regulation of activity...), and other mechanisms. The legal texts regulating the period of the Corona epidemic enabled the governor to activate new preventive precautionary measures approved by those texts, which are more restrictive and restrictive of freedoms, represented in: Imposing social distancing measures, including procedures for suspending and regulating activities, closing and harnessing individuals and facilities, approving comprehensive or partial home quarantine, and others. And he left to the governor wide discretionary authority to take any measures he deems necessary to limit the spread of the epidemic, even if it exceeds the limits of normal legality for considerations of maintaining order and protecting the public interest, but those actions issued by the governor during this period remain subject to political control on the one hand, and judicial control on the other hand , as a guarantee to protect rights and freedoms
