حماية الموظف من تعسف الإدارة في التشريع الجزائري

Abstract

يتمتع الموظف العام في الإدارة العمومية في الجزائر بجملة من الحقوق حفظتها له التشريعات المتوارثة. وقد اقر المشرع بالحماية القانونية لهذه الحقوق على اختلافها المادية منها والاجتماعية وكذا الحقوق النقابية، إضافة لحمايته اثناء المساءلة التأديبية، وفي ظل ذلك منح له عدة ضمانات لمواجهة تعسف الإدارة كالضمانات الإدارية والمتمثلة في اجراء التحقيق وحق الاطلاع على الملف الشخصي وضمانات أخرى قضائية تتمركز أساسا في دعاوى الإلغاء ودعاوى التعويض. وبالرغم من هذا الاثراء القانوني بشأن حقوق الموظف وحمايتها من تعسف الإدارة، الا انه يتضح جليا نقص فعاليتها خاصة وان الإدارة هي الحكم والخصم في ان واحد.

The public servant of the Public Administration of Algeria has a number of rights that have been preserved by inherited legislation. The legislator recognized the legal protection of these rights, regardless of material and social rights, as well as trade union rights, as well as his protection during disciplinary accountability, in which he was granted several guarantees to counter the abuse of management, such as administrative guarantees of conducting an investigation, the right to access the profile and other judicial guarantees, mainly in cancellation and compensation claims. Despite this legal enrichment of employee rights and their protection from mismanagement, it is clear that they are ineffective, especially since management is the arbiter and the adversary in one.
