القواعد الآمرة والمفسرة وتطبيقاتها الشرعية والقانونية

Abstract

نستخلص من خلال درستنا لهذا الموضوع أن القاعدة القانونية تنقسم من حيث قوتها إلى قواعد آمرة ، وقواعد مكملة أو مفسرة، بحيث أن القواعد الآمرة لا يجوز للأفراد الاتفاق على خلاف حكمها مثل تحريم القتل، ومن تطبيقاتها نجد من جانب المعاملات المالية قاعدة تطبيق على سكوت المتعاقدين ،وفيما يخص الأحوال الشخصية لدينا ت تطبيق على القاعدة التي تحرم الربا. أما القواعد المفسرة فهي لا يجوز للأفراد الاتفاق على ما يخالفها ،مثل اتفاق المتعاقدين على دفع الثمن ،ومن تطبيقاتها لدينا قاعدة الثمن السوق فيما يخص المعاملات المالية، وقاعدة مهر المثل فيما يخص الأحوال الشخصية.

We conclude through our study of this topic that the legal rule is divided in terms of its strength into peremptory rules, complementary or explanatory rules, so that peremptory rules are not permissible for individuals to agree on contrary to its ruling, such as the prohibition of murder, and from it s applications we find on the part of financial transactions a rule of application to silence The contracting parties, and with regard to our personal status, the rule prohibiting usury is applied. As for the interpreted rules, it is not permissible for individuals to agree on what contradicts them, such as the agreement of the contracting parties to pay the price, and among its applications we have the market price rule with regard to financial transactions, and the rule of the proverbial dowry with regard to personal status
