Abstract: لا شك أن المشرّع خلال وضعه لقواعد قانون الأسرة يبذل جهدا من أجل إخراج قانون سليم نصا وأحكاما، لاسيما أن جل القوانين الوضعية تكاد لا تخلو من نقص أو غموض أو قصور أو إغفال لأنها ببساطة ليست قرآنا منزلا من عند الواحد الديّان، وعلى غرار كل واضع للتشريع حاول المشرّع الجزائري حين وضعه لقواعد قانون الأسرة الجزائري 84/11 المؤرخ في 09 جوان 1984 إخراجه في قواعد منتظمة مرتبة غير متناقضة، وهو ما حرص عليه كذلك بعد تعديله بالأمر 05/02 المؤرخ في 27 فبراير 2005، لكن بالرغم من ذلك ومن خلال التطبيق العملي برزت العديد من الإشكالات أبانت قصور هذا القانون، من خلال سكوت المشرّع عن كثير من المسائل التي تحتاج إلى بيان عند وضعه للتشريع الأسري، مما أثار لدي ملكة البحث محاولا الإجابة عن الأسئلة المطروحة حول إمكانية القواعد القانونية التي يحتويها قانون الأسرة الجزائري على حل أي اشكال يعترضها في ظل سكوته عن مسائل مهمة تحتاج إلى بيان، وحول مدى إسهام الاجتهاد القضائي للمحكمة العليا في سد الفراغات الناجمة عن سكوت القانون. للإجابة عن هذه الأسئلة سلكت مسلكا منهجيا حيث قسّمت من خلاله البحث إلى بابين متطرقا في الأول منهما إلى بيان المسكوت عنه في الزواج وآثاره، أما الباب الثاني فتعلّق بما سكت عنه قانون الأسرة الجزائري في انحلال الزواج وآثاره، و قد نتجت عن هذه الدراسة عدة نتائج أهمها: ضرورة إعادة صياغة قواعد قانون الأسرة الجزائري في قادم التعديلات، لأن الكثير من المسائل تحتاج إلى إبانة، مع التركيز على النصوص التي كانت محط اهتمام الباحثين لما أثارته من إشكالات عملية وسكت عنها القانون في الزواج وآثاره خصوصا ما تعلّق منها بمقومات الزواج وحقوق الزوجين والنفقة، وما كان ذا أهمية في انحلال الزواج من مسائل الطلاق والشقاق وما ينتج عنه من مسائل ذات خطورة كحضانة الأولاد.
The inclusion by the legislature of norms to Family Code in the text of provisions goes to show a significant effort, especially since all Man-made Laws are almost not devoid of defects, ambiguities, shortcomings or omissions, because they are simply not a Qur’an revealed by the One, the true Judge. But unlike all legislative drafters, the Algerian legislature, for its part, has tried to set up regular, arranged, non-contradictory legal bases of the Algerian’s family law rules 84-11 of 9 June 1984, amended by Order 05-02 of 27 February 2005. Nonetheless, after practical execution, many problems had been emerged showed the shortcomings of this law, as the legislature neglected many issues that need to be clarified regarding family legislation, thus raising an interesting question about the legal bases of the Algerian’s family law rules capability to solve any problem that obstruct their implementation in light of the legislature’s disregard of important issues that need to be addressed, and the extent to which the Supreme Court Jurisprudence contributed to filling the gaps arising from the silence of the law. In order to answer these questions, the researcher took a methodological approach, in which the paper has been divided into two chapters; the first addressing the undiscussed issues in marriage and its consequences, while the second relating to what the Algerian family law disregard in the dissolution of marriage and its effects. This study revealed several results, the most important of which are the need for reformulating the Algerian’s family law rules in the next amendments, for the purpose of addressing many issues, focusing on the legal provisions under study and the practical problems it raised in marriage and its effects, especially those related to marriage elements, spouses rights and alimony, and what was important in the dissolution of marriage in terms of divorce and marital discord, as well as the consequent serious issues, such as custody of children.
