Abstract

هذا بحث بعنوان: الترجيحات الفقهية عند قطب الأئمة امحمد بن يوسف اطفيش من خلال كتابه شامل الأصل والفرع -دراسة نماذج- تناول البحث التعريف بالــمُؤلِّف وتكوينه العلمي ثم نتاجه الفكري حيث إن القطب أظهر نبوغا في العلم في مقتبل العمر مما جعله يتبوأ صدارة العلماء وغدا مرجعا للفتوى عند الإباضية مشرقا ومغربا، وجاءت هذه الرسالة لتسلط الضوء على أحد مؤلفاته و نتاجه الفكري كتابه "شامل الأصل والفرع" وتبين قيمته العلمية ومنهجه في التأليف ومحتوياته، إذ يعد الكتاب من أحسن ما ألَّفه القطب في مجال الفقه على طريقة المتقدمين ووضعه في متناول المبتدئين. وتَكمُنُ قيمته العلمية أنه ألفه بعد أن بلغ درجة الاجتهاد المطلق. وعرج البحث بعد إلى التعريف بالترجيح وشروطه وأحكامه عند الأصوليين والفقهاء وقد نهج القطب الترجيح الفقهي في كتابه واتبع مسالكه، بالنظر في مقاصد النصوص ومراعاة الواقع، واعتبار القواعد الأصولية والفقهية في الترجيحات منهجا سديدا واستعمل لذلك مصطلحاته الخاصة عند الترجيح، ثم أورد البحث بعض النماذج الترجيحية الفقهية المبثوثة في ثنايا "شامل الأصل والفرع" وحاول أن يبرز رأي القطب فيها بعد عرض المسائل على المنهج المقارن المتعارف عليه بين أرباب هذا الفن وفي الأخير خلص البحث إلى أهم النتائج منها: أن القطب كان يعرض أقوال العلماء وينسبها إلى أصحابها، ويحرر محل النزاع ويسوق أدلتها، ويناقشها بكل أناة واحترام، ثم يُرجح بينها بالدليل ولو خالف آراء علماء مذهبه، معتبرا أن في كل مذهب رأيا راجحا ومرجوحا. لذا فقد انفرد القطب ببعض الآراء الفقهية، كما أن انتسابه إلى المدرسة الإباضية لم يكن له حائلا أن يستفيد من جهود علماء الإسلام من مختلف المدراس الفقهية على تنوع آرائها. والكتاب بحاجة ماسة إلى التحقيق العلمي والاستفادة منه.

This research is entitled by: the jurisprudential preferences of Kutb Cheikh M'Hamed son of Youcef Tfeich, through his book of "Shamil al-Asl wu al-Far'a - models of study". The research tackled an introduction of the author, his academic training, then his intellectual heritage, as he was a prominent scholar who ranked among the top scholars of his time and the reference of Fatwa for Ibadists both in the east and the west. The thesis shed lights one of his books that represent his intellectual background called "Shamil al-Asl wu al-Far'a", which demonstrates his scientific value and his writing approach. It is considered as one of his greatest writing achievements in the field of jurisprudence, inspired by the predecessors and targeting beginners. The scientific value of the book is lied in the fact that it was written at the time when Cheikh kutb reached the independent-reasoning level. The research then defined preferences, their conditions and rules for the jurisprudence principle scholars and jurisprudents, knowing that Cheikh Kutb performed the jurisprudential preference approach in his book, regarding the purposes of Islamic scriptural sources as well as reality, in addition to considering the rules of jurisprudence principles and jurisprudence in his preference as the right method using his special terminology of preference. The research mentioned some jurisprudential preference models indicated in the book of "Shamil al-Asl wu al-Far'a", where Cheikh Kutb tried to demonstrate his opinion after introducing the matters on the comparative approach known by the leaders of this subject. Finally, the research concluded by these important results: Cheikh Kutb used to introduce scholars' opinions, tries to solve the disagreement, discusses them carefully then makes a preference based on an evidence even if it disagrees with the opinions of his doctrinal scholars. He considers that every doctrine has a dominant and non-dominant opinion. Therefore, Cheikh Kutb made some unique juriprudential opinions, as belonging to the Ibadit school did not refrain him from benefiting from the Islamic scholars' efforts of various juriprudential schools and thoughts. This book is in a desperate need of scientific analysis and learning of its knowledge.
