ترجيحات ابن بزيزة الفقهية في كتابه روضة المستبين

Abstract

يكشف هذا البحث عن التّرجيحات الفقهية لابن بزيزة التونسي، وهو من فقهاء المالكية؛ عاش في القرن السّابع الهجري في فترة الدّولة الحفصية مرحلة الازدهار والاستقرار، وذلك من خلال كتابه روضة المستبين شرح على كتاب التّلقين والذي يعتبر من أمّهات الكتب في المذهب المالكي لمؤلفه القاضي عبد الوهاب البغدادي، فكانت هذه التّرجيحات ذات الصّيغة الصّريحة للمسائل الفقهية المدروسة داخل المذهب أو خارجه موزّعة على الأبواب الفقهية من عبادات ومعاملات وعقوبات، فقد يوافق ابن بزيزة بترجيحاته وَفق هذه المسائل مذهب مالك أو يخالفه كلّ ذلك حسب ما يقوده إليه اجتهاده ونظرُه في الأدلة ؛ ممّا يدلّ على أنّه من الفقهاء المجتهدين.

Le document vise à explorer les poids jurisprudentiels d'Ibn Baziza Ettounsi, l'un des savants Malikite, qui a vécu au 7ème siècle Hijri - pendant le Hafside âge d'or. Pour ce faire, nous parcourons son livre «Rawdat El-Moustabin» une explication de «Kitab Al-Talquine»; l'un des livres classiques du rite Malikite, écrit par ElKadi Abd El Wahab Elـ Baghdadi. Ces clairs poids des questions jurisprudentielles, à l'intérieur et à l'extérieur du rite Malikite, ont été classés en cultes, relations et punitions. Avec ses poids, Ibn Baziza peut être en dés/accord avec le rite Malikite en fonction de sa pensée et sa vision des preuves; cela signifie qu'il est l'un des savants qui travaillent dur.

The paper aims at shedding light on the jurisprudential importance of Ibn Baziza Ettounsi, one of the Maliki scholars, who lived in the 7th Hijri century – during the Hafsid Golden Age. To do so, we go through his book “Rawdat El-Moustabin” an explanation of “Kitab Al-Talquine”; one of the classical books for the Maliki School, written by ElKadi Abd El Wahab El Baghdadi. These clear weights of the jurisprudential questions, inside and outside the Maliki School, were classified into worships, dealings, and punishments. With his values, Ibn Baziza may dis/agree with the Maliki School depending on his thought and take on the proofs; this means that he is one of the hard-working scholars
