العقد المالي بين الزوجين في قانون الأسـرة الجزائري مقارنة بالفقه الإسلامي

Abstract

تناولت هذه الرسالة موضوع العقد المالي بين الزوجين مقارنة بين الفقه الإسلامي و قانون الأسرة الجزائري ‘ بحيث تمت الإجابة علی التساؤلات المطروحة كبيان مدلول العقد‘ و تحديد أهم نظامين يرتكز عليه هذا العقد ‘ و قسم هذا البحث إلى ثلاثة مباحث‘ فالمبحث الأول منها مدلول العقد و أهم نظاميه في كلا من الشريعة الإسلامية و قانون الأسرة الجزائري ‘ و ذلك من خلال المطلبين المذكورين فيه. و بينما المبحث الثاني يتمحور حول مفهوم عقد الإشتراك و خصائصه بحيث يتم تحريره في مطلبين وفق الشريعة الإسلامية و قانون الأسرة الجزائري. و أخيراً المبحث الثالث تضمن النتائج المترتبة عن التدبير المشترك بين الزوجين ‘ و ثم تتويج هذا المبحث بجملة من النتائج دلت في مجملها علی أن العقد المالي للزوجين نظام يمثل أهمية كبيرة في تنظيم العلاقات المالية بينهما.

This thesis dealt with the issue of the financial contract between the spouses, a comparison between Islamic jurisprudence and the Algerian family law, so that the questions raised were answered as a statement of the meaning of the contract, and the identification of the two most important systems on which this contract is based. The most important of his systems in both Islamic law and the Algerian family law, through the two requirements mentioned in it. While the second topic deals with the concept of the participation contract and its characteristics, so that it is written in two requests in accordance with Islamic Sharia and Algerian family law. Finally, the third topic included the results of the joint arrangement between the spouses, 'and then this topic culminated with a set of results that indicated in their entirety that the financial contract of the spouses is a system that represents great importance in organizing the financial relations between them.
