Abstract

لقد تمحور موضوع المذكرة المعنون بـــ * قواعد البيوع من فروق القرافي ترتيب البقوري - من القاعدة الخامسة عشرة إلى القاعدة العشرون - دراسة تأصيلية فقهية * ,وقد ذكرنا فيه ترجمة للإمام القرافي والإمام البقوري ودرسنا منهج كتابيهما ,ثم بعدها شرعنا في دراسة قواعد البيوع المقررة علينا وهي خمسة قواعد وهي كالتالي : 1- القاعدة الخامسة عشرة: في تقرير مايجوز بيعه قبل قبضه وما لا يجوز. 2- القاعدة السادسة عشرة :في تقرير ما يتبع العقد عرفا وما لا يتبعه. 3- القاعدة السابعة عشرة :في تقرير ما يجوز به بيع السلم ويصح , 4- القاعدة الثامنة عشرة :في أن الصلح في الأموال دائر بين خمسة أمور : البيع ,والصرف ,والإجارة ,ودفع الخصومة ,والإحسان. 5- القاعدة التاسعة عشرة :في تقرير حكم الأهوية ,وتقرير حكم ما تحت الأبنية. 6- القاعدة العشرون :في تقرير ما معنى الذمة ,وما معنى أهلية المعاملة ؟ وأنهما ليسا بمعنى واحد كما يعتقد بعض الناس ,وأن هناك فرقا بين أهلية الالتزام واللزوم ,وأهلية التصرف. ثم ذكرنا الخاتمة وبينا فيها أهم النتائج المتوصل إليها وألحقناها بفهرس الموضوعات في الأخير.
