الأنشطة التجارية المنظمة في التشريع الجزائري

Abstract

اعتمدنا في تحليل موضوع الأنشطة التجارية المقننة على فصلين أولهم تطرقنا لماهية الأنشطة التجارية المقننة، بحيث تعتبر الأنشطة التجارية المقننة بأنها ذات طابع خاص ولا يسمح بممارستها إلا إذا توفرت الشروط التي يتطلبها التنظيم ومن شروطها إنها تتطلب رخصة، بالإضافة إلى تسجيل هذه الأنشطة التجارية في السجل التجاري، فالأنشطة التجارية لها خصائص منها خاصية التحيين وخاصية المرجعية وتختلف هذه الأنشطة عن باقي الأنشطة الأخرى، فمصطلح النشاط مصطلح اقتصادي، أما مصطلح الأعمال مصطلح قانوني والفصل الثاني تناولنا فيه تنظيم المشرع للأنشطة التجارية المقننة وهذا بتبيان أسس ممارسة الأنشطة التجارية المتمثلة الإجراءات وهي الرخصة والاعتماد والقيد في السجل التجاري، أما شروط ممارسة هذه الأنشطة، الأهلية والذمة المالية، بالإضافة إلى الاسم والموطن، كما أعطى حق للأجانب بممارسة الأنشطة التجارية وهذا بعد لحصول على بطاقة التعريف المهنية للتاجر الأجنبي .

In analyzing the subject of regulated commercial activities, we relied on two chapters, the first of which we touched on the nature of regulated commercial activities, so that regulated commercial activities are considered to be of a special nature and are not permitted to be practiced unless the conditions required by regulation are met, among which are the conditions that they require a license, in addition to the registration of these commercial activities in the commercial registry Commercial activities have characteristics, including the feature of updating and the feature of reference, and these activities differ from the rest of the other activities. The term activity is an economic term, while the term business is a legal term and the second chapter we dealt with the legislator’s regulation of regulated commercial activities. The commercial register, as for the conditions for practicing these activities, eligibility and financial disclosure, in addition to the name and domicile, it also gave the right to foreigners to practice commercial activities and this is after obtaining the professional identification card for the foreign trader.
