تعارض الأدلة العقلية وطرق دفعه في المذهب المالكي

Abstract

التعارض هو التقابل بين دليلين أو أكثر بحيث يقتضي كل منهما عكس مايقتضيه الأخر، وتعد دراسة التعارض والترجيح من أهم الدراسات الأصولية التي اهتم بها أهل العلم، وذلك لبيان أن أدلة الشرع لا تعارض بينها في ذاتها في الواقع ونفس الأمر وإنّما التعارض ظاهري يقع في ذهن المجتهد ويجب دفعه، ودفع تعارض الأدلة العقلية في المذهب المالكي قائم على الترجيح بإحدى المرجحات المعتبرة أو القول بالتخيير أو التوقف عند تعذر الترجيح، وتميزت طريقة المالكية في دفع تعارض الأدلة العقلية بقوة مراعاتهم للمصالح ورفع الحرج مع الأحتياط والتشدد في حال الشبهة والتهمة.
