حدود الرقابة القضائية على أعمال السلطات الإدارية المستقلة

Abstract

تشكل السلطات الادارية المستقلة وجه جديد لدور الدولة،و يرجع الفضل في ظهورها للدول الانجلوساكسونية . و عرفت الجزائر السلطات الادارية المستقلة بداية التسعينات ، قد منحها المشرع سلطات واسعة تتعدى تلك الممنوحة للهيئات الادارية التقليدية ،حيث تمكنها هذه السلطات صلاحية اتخاذ القرارات الفردية و التنظيمية ، و حتى لا تنحرف في ممارسة هده السلطات حددها المشرع من حيث الزمان و الموضوعات، كما أخضعت قراراتها لرقابة القاضي على مستوى مجلس الدولة كأصل عام ، تحكمه قواعد إجرائية و موضوعية نصت عليها النصوص المنشئة لهاته السلطات. و في حالة عدم وجود نصوص يلجأ القاضي لتطبيق القواعد العامة الواردة في قانون الاجراءات المدنية و الادارية للفصل في منازعات السلطات الادارية المستقلة.

The legislature granted them wide powers that go beyond those granted to traditional administrative bodies, as these authorities enable them to make individual and organizational decisions, so as not to deviate from the exercise of these powers, which were defined by the legislator in terms of time and topics, as they were subjected to Its decisions are controlled by a judge at the level of the State Council as a general rule, governed by procedural and substantive rules stipulated in the texts establishing these authorities. And in the absence of texts, the judge will resort to applying the general rules contained in the Civil and Administrative Procedures Law to settle the disputes of independent administrative authorities
