Abstract

إن مسألة التوازن العقدي أصبحت يثير إشكالات فقهية في ظل المبادئ التقليدية التي أصبحت لا تحقق الحماية الكافية للمستهلك من خطر اللاتوازن في العقد، باعتبار أن المستهلك هو الطرف الضعيف في العلاقة التعاقدية الاستهلاكية لإفقاره للخبرة ونظرا للقوة الاقتصادية للمنتج مقدم الخدمة. وعليه في ظل المبادئ المستحدثة تم إقرار حماية خاصة للمستهلك بمنحه مجموعة من الحقوق بالموازاة مع ذلك تم توسيع دائرة التزامات المحترف وكذا تشديد من مسؤولية المحترف كل هذا لتحقيق توازن في العقود الاستهلاكية يرضاه المستهلك والمنتج.
