Abstract

يعد الشيخ عبد الله بن بيه من أكبر علماء السنة المعاصرين، حيث ينظر إليه الكثير من المسلمين كأحد رموز الاعتدال والوسطية، واشتهر بآرائه الفقهية للعالمين الإسلامي والغربي، كما أخذت فتاواه وآراءه مكانتها في الغرب كواحدة من أهم المصادر والمراجع للأقليات الإسلامية التي تعيش في تلك الدول، وتتميز بالاستيعاب العميق للأصول الشرعية والمعرفة الواعية بالواقع المعاصر مما يمكنه من إيجاد الكثير من الحلول لما يستجد من عقبات في طريق المسلم المعاصر، فكانت الدراسة تدور حول التجديد الفقهي عند الشيخ بن بيه، التي اعتمدت فيها المنهج الاستقرائي التحليلي، حيث حاولت الوقوف على بعض القضايا الفقهية سواء التي سئل عنها، أو التي أبدى فيها برأيه الخاص، وماهي الطريقة التي انتهجها في ذلك. ومن بين النتائج المتوصل إليها: - أن التجديد عند الشيخ بن بيه هو: إدراج مضمون حديث في مفهوم قديم في قراءة جديدة للأصول؛ قواعد ومقاصد وعلاقتها بالجزئيات الفقهية على ضوء مستجدات العصر. - من خلال ما يقدم من فتاوى، يحاول أن يزواج بين الأصالة والمعاصرة، فهو يجعل من التراث حافزا لا حاجزا. - من خلال ما يقدم من فتاوى أيضا، تجده يراعي للأقوال التي بها يتحقق المقصد الشرعي، وإن كانت الأقوال ضعيفة أو مرجوحة، كمقصد كمراعاة المصالح والمفاسد، التيسير ورفع الحرج والمشقة....
