الاطار القانوني لجودة الخدمة العمومية في الجزائر

Abstract

حظي مفهوم جودة الخدمة العمومية بأهمية متزايدة نظرا لزيادة المشاكل التي شهدتها عملية تقديم الخدمة العمومية من ترديها وبطئها وتعقيد إجراءات الحصول عمليا ، وهذا ما أدى إلى الاستعانة بآليات ومبادئ التسيير العمومي الجديد في عملية تسيير المرافق العامة، وتم تكريس مبدأ الجودة بوصفه مبدءا جديدا يحكم عمل وسير المرافق العامة، فهذه الدراسة تهدف إلى إبراز مدى وجود إطار قانوني لجودة الخدمة العمومية في المنظومة القانونية الجزائرية، وذلك من خلال تناول ماهيتها وكذا التأصيل القانوني لها في التشريع الجزائري وبعض التشريعات المقارنة، كما ستتناول مدى إمكانية قياس جودة أداء المرافق وكذا شروط ومقتضيات تجويد الخدمة العمومية، كما ستتطرق إلى آليات تجسيد جودة الخدمة العمومية كإدارة الجودة الشاملة والإدارة الالكترونية ،إضافة إلى أخلقة المرافق العامة ومكافحة الفساد بجميع صوره واشكاله.

The concept of quality of public service has gained increasing importance due to the increase in the problems in the process of providing public service such as its poor quality, slowness and the complexity of the procedures for obtaining it. Public utilities, this study aims to highlight the extent to which there is a legal framework for the quality of public service in the Algerian legal system, by addressing its nature as well as the legal rooting of it in Algerian legislation and some comparative legislation. It will address mechanisms for embodying the quality of public service, such as comprehensive quality management and electronic management, in addition to the ethics of public utilities and the fight against corruption in all its forms and manifestations.
