الضمانات القانونية والرقابية لممارسة حق الانتخاب في ظل التعديل الدستوري لسنة 2020

Abstract

-أقر المشرع الانتخابي مجموعة من الآليات القانونية والرقابية، هدفها ضمان ممارسة حق الانتخاب بكل حرية ونزاهة، من خلال النص على ضمانات لسلامة المرحلة التمهيدية للعملية الانتخابية، وكذا المرحلة المعاصرة واللاحقة عليها، إلى جانب اعتماد آليات مختلفة للرقابة إذا ما شابت هذه الإجراءات تجاوزات تؤثر على حرية اختيار الناخب، تتوزع بين رقابة مستقلة تقوم بها هيئات وطنية مستقلة لمراقبة الانتخابات، وهيئات دولية من منظمات حكومية وغير حكومية، إلى جانب رقابة قضائية من طرف هيئات القضاء العادي والإداري، والمحكمة الدستورية باعتبارها قاضي انتخاب.

By establishing guarantees for the security of the initial stage of the electoral process as well as the contemporary and subsequent stages, the electoral legislator approved a set of legal and supervisory mechanisms with the goal of ensuring the exercise of the right to vote freely and fairly. in additionally implementing alternative supervisory methods if these processes are tainted by transgressions that impact electoral freedom. Voters have a choice between judicial oversight by regular and administrative judicial bodies, independent national election monitoring organizations, international bodies of governmental and non-governmental organizations, and the Constitutional Court acting as an election judge.
