تخريج الفروع على الفروع عند فقهاء توات

Abstract

جاءت دراستي هذه تأصيلا لفن تخريج الفروع على الفروع عند فقهاء حاضرة توات المالكية، وبيانا لأثره في ما حل ببلادهم من قضايا ومسائل، وقد قسمنها إلى مقدمة وبابين وخاتمة؛ فأما الباب الأول فجعلته من فصلين، أفرد أولاهما لرصد الحركة الاجتهادية الفقهية بالحاضرة عبر مراحل ثلاث، وخصص ثانيهما للتعريف بفن تخريج الفروع على الفروع، وبيان موقف فقهاء توات منه، ومدى اعتمادهم عليه في العملية الاستنباطية. أما الباب الثاني فجاء حاويا للتعريف بغنية المقتصد السائل في فصله الأول، ولبعض تطبيقات تخريج الفروع على الفروع فيها بفصله الثاني. وفي الخاتمة دكرت النتائج المتوصل إليها من الدراسة المتواضعة هذه.

The study aims at tracing the origins of the art of measuring branches (of fiqh) against other branches adopted by Tuoat Maliki scholars. It is also an attempt to show the impact of this art on the questions and cases that faced their cities. The study is divided into an introduction, two parts and a conclusion. The first part is devoted to the scholarly movement in Touat, through three stages. The other part was devoted to measuring branches against other branches, and showing the scholars’ views about it. It also shows the extent to which scholars relied on this method. The first chapter of the first part is devoted to the first chapter of Ghoniat el-moktasid Essail. The second chapter contains some applications of measuring branches against other branches.
