جريمة شهادة الزور في الشريعة الإسلامية والقانون الوضعي

Abstract

إن الشريعة الإسلامية جاءت بالتحذير الشديد من ارتكاب جريمة شهادة الزور، خلال النصوص الشرعية، قال تعالى:﴿فَاجْتَنِبُوا الرِّجْسَ مِنَ الْأَوْثَانِ وَاجْتَنِبُوا قَوْلَ الزُّور﴾ ،[سورة الحج 30] ومن صفات المؤمنين أنهم لايشهدون زورا، ولايقولون إلا حقا، فهي من أعظم الذنوب بعد الشرك بالله لما فيها من مفسدة للدين والدنيا وللفرد والمجتمع, وكبيرة من الكبائر فهي سبب في انتهاك الأعراض وإزهاق النفوس وأخذ أموال الناس ظلما وجورا، وتحريم حلال وتحليل حرام، لذلك وضع الإسلام عقوبات تعزيرية للحد من تفشيها وردع مرتكبيها. كما ان القانون الجزائري جاء على خلاف باقي القوانين بتجريمه لشهادة الزور، ووضع عقوبات صارمة لها تختلف باختلاف نوع الجريمة، ولكل جريمة عقوبة خاصة بها، فالعقوبة المقررة في مواد الجنايات تختلف عن العقوبة المقررة في مواد الجنح والمخالفات وهذا كله لردع المجرمين والحد من ارتكاب هذه الجريمة لما فيها من إلحاق الضرر بالمجتمع والعدالة ، وإن أهمية هذه الدراسة هي أن ارتكاب جريمة شهادة الزور يعكس مدى اضطراب الجانب الأخلاقي لدى الإنسان وعدم خوفه من الله عز وجل، وتجرؤه على الكذب. فيؤدي إلى عرقلة حسن سير العدالة ويتسبب في إلحاق الضرر بالفرد والمجتمع.

The Islamiclaw came with a strong warning againstcommitting the crime of false testimony, through the legaltexts, the Almightysaid: {So avoid the filth of idols, and avoid false speech} Surah Al-Hajj (30),[Surah Al-Hajj 30] Among the characteristics of the believersisthatthey do not bear false witness, and theyonlyspeak the truth. It is one of the greatestsinsafterassociatingpartnerswithGod, becauseitcorrupts religion, the world, the individual, and society, and itis a great sin, as itis a cause of violatinghonor, takingpeople’s money unjustly and unfairly, and prohibitingwhatis permissible and delegatingwhatisforbidden, so Islam has set disciplinarypunishments to limititsspread and deteritsperpetrators. Also, the Algerian law came unlike the rest of the laws by criminalizingperjury, and setting strict penalties for itthatdifferaccording to the type of crime, and each crime has itsown penalty. Becauseitharms society and justice.The importance of this study is that committing the crime of perjury reflects the extent of the moral disturbance of man, his lack of fear of God Almighty, and his daring to lie. It obstructs the proper administration of justice and causes harm to the individual and society.
