حجية التوقيع الإلكتروني في التشريع الجزائري

Abstract

لقد عرف العالم تطورا مستمرا على جل المستويات ولاسيما المجال التكنولوجي والابتكار. نتج عن التطور التكنولوجي الحديث، واستخدام شبكة المعلومات العالمية ظهور وسائل وتقنيات حديثة من بينها التوقيع الإلكتروني,لم تعد الوسيلة التقليدية في الإثبات وتوثيق المعاملات الورقية وهي التوقيع الخطي أو اليدوي ملائمة للصورة الحديثة للمعاملات التي تأخذ الشكل الالكتروني, التوقيع الالكتروني يختلف عن مفهوم التوقيع التقليدي كما أنه يثير عدة مشاكل منها التعاقد الالكتروني, كان لابد من دراسة أهمية التوقيع الالكتروني وحجيته في الإثبات في التشريع الجزائري.
