منهج الإمام أبي القاسم ابن عظوم في الفتاوى من خلال كتابه الأجوبة

Abstract

إن من أهم العلوم وأعظمها مرتبة علم الفقه الذي يضبط تصرفات المكلفين بما أراد رب العالمين ويورث الملتزمين أحكامه الأمن في الدارين. ولهذا الفضل والمنقبة اهتم به العلماء تعلما وتعليما وتأليفا، فكان من أبرز فنون علم الفقه علم الفتوى الذي يشتغل به جهابذة العلماء ليبينوا للناس أحكام ما استجد لهم من وقائع في حياتهم، وتبعا لهذا الدور الكبير للفتوى والآثار المترتبة عليها، رأيت أن تكون دراستي حول فتاوى عالم بارز في عصره وهو: المفتي أبو القاسم ابن عظوم، وعنونتها ب: "منهج الإمام أبي القاسم ابن عظوم في الفتاوى من خلال كتابه الأجوبة" وقد سعت الدراسة إلى الإجابة عن الإشكال التالي وهو: هل للإمام أبي القاسم ابن عظوم منهج خاص به في الفتوى؟ أم كان مجرد مقلد لغيره في منهجه الإفتائي؟. وحتى أجيب عن هذا الإشكال جعلت هيكلة البحث إلى: فصل تمهيدي للتعريف بالإمام أبي القاسم ابن عظوم وأجوبته؛ وبابين، الأول لبيان خصائص وأدوات الفتوى ومراحل استصدارها عند الإمام في كتابه الأجوبة، الثاني لبيان منهجه في الاستدلال للفتوى بأصول المذهب وأقواله المعتمدة وكذا بيان منهجه في التخريج الفقهي. وبعد الدراسة تبين أن الإمام لم يخرج في منهجه الإفتائي عن الأقوال المعتمدة في المذهب المالكي مستدلا بأصوله وسالكا منهج حذاق المدرسة المغربية القائم على تصحيح الروايات والعناية بتهذيب المسائل، والتنبيه على اضطرابات الألفاظ، وبيان الوجوه في كلام وأقوال العلماء، معتمدا في ضبط منهجه على الوسطية والاعتدال والاحتياط مستعملا لفنون علمية لا بد منها للمفتي. إن أهمية هذه الدراسة تتجلى في كونها تبرز الجهود العلمية والعملية التي أنجزها علماء المالكية في مجال الفتوى.

One of the most important and greatest sciences is the science of jurisprudence, which controls the actions of those charged with what the Lord of the Worlds wills, and bequeaths to those committed to its rulings security in both homes. It is for this virtue and merit that the scholars cared about in learning, teaching, and authorship. One of the most prominent arts of jurisprudence was the science of fatwa, which the wise men of scholars worked with to explain to people the rulings of the facts that occurred to them in their lives. And according to this great role of the fatwa and its implications, I thought that my study should be about the fatwas of a prominent scholar of his time, namely: Mufti Abu al-Qasim Ibn Azum, Its title was: “The Approach of Imam Abu al-Qasim Ibn Adzoum in Fatwas Through His Book of Answers.” The study sought to answer the following question: Does Imam Abi al-Qasim Ibn Adzoum have his own approach to fatwa? Or was he just an imitator of others in his fatwa approach? In order to answer this problem, I structured the research into: an introductory chapter introducing Imam Abi Al-Qasim Ibn Adzoum and his answers; In two chapters, the first is to explain the characteristics and tools of the fatwa and the stages of its issuance by the imam in his book Al-Ajwab. After the study, it became clear that the imam did not deviate from the approved sayings in the Maliki school of thought in his method of fatwa, citing its origins, and following the approach of the skill of the Moroccan school, which is based on correcting the narrations and caring for the refinement of issues, and alerting to word disorders, and explaining faces in the words and sayings of scholars, relying on adjusting his method on moderation and moderation. And the precaution is used for scientific arts that are essential for the Mufti. The importance of this study is evident in the fact that it highlights the scientific and practical efforts made by the Maliki scholars in the field of fatwa.
