المسؤولية الجنائية للشخصية المعنوية

Abstract

إن فكرة مسؤولية الشخص المعنوي جنائيا كانت فكرة غير مطروحة قبل مدة وجيزة, وقد تمخض عنهما اتجاهان فقهيان الأول يعارض هذه المساءلة وأرجع ذلك لطبيعة الافتراضية لهذه الشخصية, وأن هذه المساءلة تتعارض مع شخصية العقوبة وأهدافها, والثاني يؤيد ويعترف بالمسؤولية الجنائية للشخص المعنوي, وقدموا في ذلك حجج وأدلة على جواز مساءلة الشخص المعنوي جنائيا، حيث أكدوا أن مساءلة هذه الشخصية جنائيا لا تتعارض لا مع مبدأ تخصيص ولا مع شخصية العقوبة وأهدافها. حتى في الفقه الإسلامي كان هناك اختلاف بين الفقهاء بخصوص هذه المسألة بين منكر ومؤيد, فقد كانت أدلة المنكرين أن هذه الجهات لا ذمة لها ولا تكليف لأن شرط التكليف هو العقل وهذه الجهات جماد والجماد لا عقل له, وأن الإنسان وحده المكلف وغير الإنسان لا تكليف له ولا ذمة

Even in Islamic jurisprudence there was a difference between scholars on this issue between denier and supporter, The evidence of the deniers has been that these actors are unscrupulous and do not adapt because the requirement of commissioning is reason and these actors are frozen and immobile. And that human beings alone are costly and not human beings are not mandated.
