القواعد القانونية للملحق في الصفقات العمومية في القانون الجزائري

Abstract

إن الملحق هو الأداة القانونية التي نص عليها المنظم الجزائري لتدارك النقائص والمستجدات التي تطرأ بعد مرحلة إبرام الصفقة العمومية وخلال مرحلة التنفيذ لها، بحيث تحول دون استكمال إنجاز الموضوع الإجمالي لهذه الصفقة العمومية، والملحق بهذه الغاية التشريعية التي وجد لأجلها، قد أطره المنظم الجزائري بمجموعة نصوص قانونية ذات طبيعة موضوعية وأخرى إجرائية، كونت في مجموعها ما يعرف بالقواعد القانونية للملحق في الصفقات العمومية في القانون الجزائري، والتي كانت موضوع بحث في هذه الأطروحة بغرض معرفة مدى كفاية هذه القواعد في تغطية الإشكالات التي يثيرها الملحق عند التنفيذ له، والتي تعيق استكمال إنجاز موضوع الصفقة العمومية الإجمالي محل الطلب العمومي.

The appendix is the legal tool; stipulated by the Algerian organizer to remedy the shortcomings and developments that occur after the stage of concluding the public deal and during the implementation phase of it. So as to prevent the completion of the overall subject matter of this public deal, and the appendix to this legislative purpose for which it was found, has been framed by the Algerian organizer using legal text, both objective and procedural in nature, which collectively formed what is known as the legal rules of the appendix in public deals in Algerian law which were the subject of research in this thesis. For the purpose of knowing the adequacy of these rules in covering the problems raised by the appendix when implementing it, which impede the completion of the subject matter for the total public deal, subject of the public request.
