تسهــيل الارشــاد للدّرر الثّمــينة من الأصـــول والفـــروع على مذهب عالم المدينة "من أول كتاب الزكاة إلى آخر كتاب الصوم" لمحمد بن العالم الزجلوي التواتي المتوفى سنة1212هـ

Abstract

يعتبر إقليم توات بالصحراء الجزائرية من جملة القلاع والمنارات العلمية في الغرب الإسلامي، فقد تبوأ بموقعه المتميز مكانة متقدمة في النشاط العلمي خاصة في القرنين 12ه-13هـ ،وظهر به علماء مبرزون،واعتبرت مكتباته خزانة وطنية زاخرة للمخطوطات في شتى العلوم والفنون،وإن غلبت عليها علوم الفقه واللغة،ومن جملة هذه المخطوطات الفقهية، ما تعلق بشرح منظومة عبد الواحد بن عاشر" المرشد المعين على الضروري من علوم الدين ،ومن أهم شروحها المخطوطة في توات شرح علاّمة وقته وفقيه عصره بالإقليم " محمد بن العالم الزجلوي " والموسوم ب:" تسهيل الإرشاد للدرر الثمينة من الأصول والفروع على مذهب عالم المدينة" ولهذا الشرح مكانة علمية متميزة في الوسط المغاربي عامة والتواتي بصفةخاصة يمكن حصر أهمها في ما يلي : أ- المؤلَفُ شرح متميز بأسلوب فقهي رسين كثير الإحالة على المتقدمين ثري التفريعات. ب- مؤلفه فقيه أصولي لغوي متضلع له مكانته العلمية في المنطقة،فهو أحد الأربعة الذين تكوّن منهم مجلس الشوري للقضاء بديار توات،وكان يرجع إليهم القاضي عبد الحق البكري التمنطيطي ، كما للمؤلف مصنفات أخرى تدل على طول باعه وكثرة زاده . ج-يعتبر المخطوط شرحا مفصلا على مقرر تعليمي للطلبة في الزوايا والكتاتيب بمنطقة الغرب الإسلامي . ومساهمنة مني في خدمة هذا الكتاب قمت بتحقيق كتابي الزكاة والصام منه ، وقد قسمت العمل على قسمين رئيسيين :قسم الدراسة وقسم التحقيق قسم الدراسة:اشتمل على أربعة مباحث: المبحث الأول في التعريف بصاحب الشرح" محمد بن العالم الزجلوي" وضمنته ثلاثة مطالب:تناولت في المطلب الأول التعريف بمنطقة توات والأوضاع السائدة خلال القرنين 12هـو13ه ، وتناولت في المطلب الثاني حياته الشخصية وفي المطلب الثالث عرضت مساره العلمي بينت أهم آثاره . وفي المبحث الثاني عرفت بصاحب الأصل " عبد الواحد بن عاشر" ومنظومته" المرشد المعين"وضمنته ثلاثة مطالب : تناولت في المطلب الأول التعريف بالناظم ، وفي الثاني ذكرت آثاره العلمية ووفاته ، وفي المطلب الثالث عرفت المنظومة وأهم شروحها. وفي المبحث الثالث قدمت دراسة على الكتاب وضمنته ثلاثة مطالب: المطلب الأول في تحقيق عنوان الكتاب ونسبته إلى صاحبه ، المطلب الثاني في ذكر أهم مصاره ومراجعه ، وفي المطلب الثالث تناولت الكتاب بالنقد وما فيه من مآخذ . وفي المبحث الرابع بينت منهجي في التحقيق وضمنته مطلبين:المطلب الأول في وصف نسخ المخطوط ، المطلب الثاني في منهج التحقيق. قسم التحقيق :حاولت إخراج هذا النص محققا مصححا قدر الإمكان بحيث يكون أقرب إلى ما خطه المؤلف،وذلك وفق منهج التحقيق العلمي. ثم ذكرت خاتمة ضمنتها خلاصة ما توصلت إليه من نتائج وتوصيات من خلال تحقيق ودراسة هذا المخطوط .

The province of TOUAT, in the Algerian desert, is considered as one of scientific beacons in the Islamic West for its advanced position in scientific activity, especially in the 12th-13th centuries AH, where mny distinguished scholars appeared. Its libraries represent a national treasury full of manuscripts in various sciences and arts, though the sciences of Islamic jurisprudence and language are dominating. Among these manuscripts the explanation of the text of Abd al-Wahed bin Asher, “The Assistant Guide to the Necessary of Religious Sciences”. On which the most important written explanation in TOUAT is the explanation of "Muhammad bin Al-Alam Al-Zajloui"; the scholar of his time in the region, entitled: "Facilitating guidance for precious pearls from the origins and branches according to the doctrine of the city's scholar." This explanation has a distinguished scientific status in the whole Arab Maghreb, and particularly in TOUAT, the most important points of which can be summarized in the following A_The author is a distinguished explanation in a well-developed jurisprudential style, with many references to applicants, rich in ramification. B_ Its author is a jurist, a fundamentalist,a linguist and a polyglot,who has a scholarly standing in the region. He is one of the four who formed the shura council of the judiciary in Diyar Touat, and judge Abdelhak Al-Bakri Al-Tantati referred to them.The author also has other works that indicate the length of his sales, and the abundance of his wealth. c_The manuscript is a detailed explanation of an educational course for students in Al-Zawiya an Al-Katatib in the Islamic west region. _As a contribution from me in the service of this book, I verified the two books of Zakat and Fasting from it, and I divided the work into two main parts: the study section and the investigation section. _The study section: It included four topic: The first topic in introducing the author of the explanation "Muhammad bin Al-Alam Al-Zajluwi" and included three demands: I dealt in the first requirement with the definition of the Touat region and the prevailing conditions during the 12th and 13th centuries AH, and in the second requirement it dealt with his personal life, and in the third requirement it presented his scientific path. _In the second topis, I was know by the originator "Abdul Wahid bin Asher" and his system "the appointed guide" and included three demand: I dealt in the first requirement the definition of the regulator, and in the second I mentioned its scientific effects, and in the third requirement I knew the system. _In the third topic , a study was presented on the book and included three demands: the first requirement to verify the title of the book and its attribution to its owner, the second requirement to mention its most important fate and refereces, and in the third requirement, it dealt with a book with criticism and its drawbacks. _In the fourth topic,I showed my approach to investigation and included two demands: the first requirement in describing and the second requirement in the investigation method. Investigation section: I tried to produce this text as corrected and verified as much as possible so that it is closer to what the author wrote, according to the scientific investigation method. Then I mentioned a conclusion that included a summary of the findings and recommendations through the investigation and study of this manuscript.
