Most of the Muslim Jurists consider that the common
man/woman (Mukallaf), although he/she has to follow the
scholars, he/she has a kind of reasoning to do: the
investigation and the search for one who fulfills the
eligibility requirements to be followed.
If the Juridical ruling appears clear, then he/she must
look how applicable the mentioned general descriptions to
his/her own case; because Juridical rulings do not address
particular issues but are general, which require a kind of
reasoning in order to apply the ruling to its right case. That
is why the common person does a kind of reasoning such as:
identifying the right water for ablution, finding the right
direction (Qibla) to pray, and this is his/her way in all of
his/her religious affairs. |
