الحماية الجنائية للشهود والخبراء في التشريع الجزائري

Abstract

تلعب الشهادة والخبرة القضائية دوراً كبيراً في الإثبات الجنائي, وفي تحقيق العدالة, على اعتبارها من أهم وسائل الإثبات المعتمد عليها في المجال الجنائي, غير أنه قد يضار الشاهد والخبير من قيامه بواجب أداء الشهادة أو إجراء الخبرة, حيث قد تتعرض حياته أو ماله أو عرضه للضرر أو الإكراه, الأمر الذي قد يمنع الشاهد من الإدلاء بشهادته أو الخبير عن إبداء رأيه بكل موضوعية حول مسألة فنية يتوقف عليها الفصل في القضية. لذلك سعت غالبية التشريعات المقارنة – بما في ذلك المشرع الجزائري- إلى إيجاد آليات قانونية كفيلة بحماية الشهود والخبراء حال أدائهم لمهامهم.
