Abstract

الاجتهاد المقاصدي عند المالكية من خلال الدَرر المكنونة في نوازل مازونة يأتي هذا البحث كإضافة علمية في مجال البحث في مقاصد الشريعة الإسلامية، خاصة على مستوى الدراسات التطبيقية التي تهدف إلى تفعيل واستثمار المقاصد في الاجتهاد، ولقد ركز البحث على إبراز أهمية هذا الجانب في عملية الاجتهاد في بحث أحكام النوازل الفقهية، من خلال الوقوف على الحضور المقاصدي في الفتاوى التي احتوى عليها كتاب" الدّرر المكنونة في نوازل مازونة" للإمام أبي زكريا يحيى بن موسى المازوني، وقد تبيّن أن كتاب " الدّرر المكنونة" يعد ميدانا خصبا لاعتبار مقاصد الشريعة في الفتوى، كما ظهرت فيه قدرة الشريعة الإسلامية على الوفاء بمصالح الناس بالرغم من اختلاف الزمان والمكان، وتعتبر محصلته العملية نماذج تطبيقية لفقه المقاصد، وبيان لمدى أهميته في بحث أحكام النوازل الفقهية.

The present research examines purposeful judgement in the fatwas of El-Durar Almaknuna fi Nuazil Mazuna by El-Imam Abu Zakaria Yahya bin Musa Al Mazouni. The research is divided into two parts: theoretical and practical. The theoretical part focuses on the paramount importance of purposeful judgement and the fiqh of the current controversial issues. The practical part, on the other hand, is devoted to purposeful judgement applications through jurisprudential issues. The study shows that El-Durar Almaknuna is a fertile land for the consideration of the purposes of Islamic law or Sharia in the fatwa. Indeed, Sharia has preserved the people’s interests despite time and place variations. Moreover, the book’s practical results are considered to be practical models for fiqh altanzil, as well as its importance in the research of jurisprudential issues. The research also shows the interest of the study of jurisprudence in the displaced reality which creates the circumstances, leading the issues included in the books of controversial jurisprudential issues to be different from the problems recorded in the books of jurisprudence.
