دور الضبط الإداري في الحفاظ على النظام العام العمراني

Abstract

يعتبر النظام العام العمراني من الأغراض الحديثة للضبط الإداري، والذي يسعى للمحافظة عليه عن طريق مخططات ورخص التعمير، وكذا الرقابة الدورية من سلطات الضبط الإداري وتدخل القضاء العادي والإداري كل هذه الوسائل والإجراءات، تشكل حماية للنظام العام العمراني، لكن هذا النظام ومنازعاته يثير عدة إشكالات بسبب تشوه أغلب مدن الجزائر، لكثرة مخالفات التعمير وضعف الرقابة والوعي، مما نتج عنه انتشار البنايات الفوضوية والتعدي على الأراضي غير القابلة للتعمير، رغم الترسانة القانونية في هذا المجال. وقد بقي المشرع متذبذب بين عقوبات الهدم، ومطابقة وإتمام البنايات المخالفة، لذا فالأمر يتطلب صرامة من سلطات الضبط وتحديد للمسؤوليات، مما يستدعي التدخل من المشرع لتعديل نصوص التعمير لتصحيح الثغرات القانونية وتوضيح إجراءات الرقابة، لردع المخالفين ولتحقيق حماية حقيقية للنظام العام العمراني.

The urban public order is considered one of the most important modern purposes for administrative police, this is done through urban plans, licenses and certificates, as well as the periodic oversight from the administrative control authorities and the intervention of the ordinary and administrative judiciary, all these means and procedures constitute protection for the urban public order, but this system and its disputes raise several problems, because to deformation of most cities in Algeria, because to the large number of urban violations and weak oversight and awareness, which resulted in the spread of messy buildings and encroachment on non-constructionable land, despite the legal arsenal in this area. The legislator has remained vacillating between demolition penalties, matching and completing the violating buildings, therefore, the matter requires the rigor from the authorities and the determination of responsibilities, this calls for intervention from the legislature to amend the construction provisions to correct legal loopholes and clarify control procedures, to deter violators and to achieve real protection for the urban public order.

L' ordre public urbain est considéré comme l'un des objectifs modernes les plus importants de la police administrative, cela se fait par le biais de plans d'urbanisme, de licences et de certificats, ainsi que par le contrôle périodique de autorités des contrôle administratif et l'intervention de la justice ordinaire et administrative, tous ces moyens et procédures constituent une protection pour le ordre public urbain, mais ce système et ses disputes soulèvent plusieurs problèmes, à cause de la déformation de la plupart des villes en Algérie, à cause du grand nombre de violations urbaines et de la faible surveillance et sensibilisation, qui a entraîné la propagation de la construction chaotique et l'empiètement sur des terrains non constructibles, malgré l'arsenal juridique dans ce domaine Le législateur est resté hésitant entre les sanctions de démolition, l'appariement et l'achèvement des bâtiments violés, donc ça prend nécessite la rigueur des autorités et la détermination des responsabilités, cela nécessite une intervention du législateur pour modifier les dispositions de construction afin de corriger les lacunes juridiques et clarifier les procédures de contrôle, dissuader les contrevenants pour assurer une réelle protection de l’ordre public urbain.
