النوازل المتعلقة بجهاد الجزائريين ضد الاحتلال الفرنسي

Abstract

الدراسة تدرس نوازل الجهاد الجزائري وغيره من النوازل ذات الصلة بمفرزات الوجود الفرنسي، ضمن قسمين اثنين: الأول دراسي انصب على دراسة واقع الافتاء زمن الاحتلال الفرنسي؛ فأبرز موقع الفتوى في المسيرة الجهادية للشعب الجزائري، وموقعها في مختلف القضايا المصاحبة للوجود الفرنسي في الجزائر، إلى جانب بيان طبيعة وخصائص الجهاد الجزائري ونوازله. أما القسم الثاني: فقد جُمعت ودُرست فيه النوازل محل الدراسة، الأمر الذي جعل اجتماعها يكشف بعض جوانب التاريخ الفقهي والثقافي للجزائر أيام الاحتلال الفرنسي. لتقف الدراسة في النهاية على ثراء النوازل المتعلقة بالجهاد الجزائري لتشمل مختلف أبواب الفقه، وبعض المسائل الخاصة بالعقيدة وأصول الدين، كما وقفت على تباين مواقف المفتين تجاه سلطة الاحتلال؛ مما يعني أن الفتوى كانت إحدى وسائل الجهاد ومواجهة المشاريع الفرنسية، وفي الوقت نفسه كانت بسبب سياسة الاحتواء إحدى روافد المشروع الاحتلالي الفرنسي.

The study examines the Algerian jihad fatwas and other issues related to the French presence in the country, within two parts: The first focused on studying the reality of the Iftaa during the time of the French occupation By highlighting the position of the fatwa in the jihadist march of the Algerian people, and its position in the various issues of that time's reality, in addition to explaining the nature and characteristics of the Algerian jihad and its fatwa. As for the second section: it contains a collection, classification, and study of the fatwas understudy, which reveals some aspects of the jurisprudential and cultural history of Algeria during the French occupation. In the end, the study focuses on the richness of fatwa related to the Algerian jihad, to include the various chapters of jurisprudence, as well as some issues related to Akida and the fundamentals of religion, the study viewed the differing positions of the muftis towards the occupation authority. This means that the fatwa is one of the means of jihad and confronting the French policy, and at the same time, it was a tributary of the French occupation project.
