التعاملات الإلكترونية في مجال الصفقات العمومية

Abstract

تتناول الدراسة مجمل الإجراءات المتعلقة بالتعاملات الإلكترونية في مجال الصفقات العمومية سواءً في مرحلة الابرام أو في مرحلة التنفيذ، من خلال إظهار الآراء الفقهية أو القانونية في هذا المجال بدءً بقوانين الأونسيترال النموذجية المتعلقة بالاشتراء العمومي؛ مروراً بقوانين وتوجيهات الاتحاد الأوروبي؛ وصولاً إلى ما توصلت إليه قوانين الدول على غرار القانون الفرنسي الرائد في هذا المجال، وبعض القوانين العربية، مع ذكر المحاولات النادرة للمشرع الجزائري في هذا المجال.

The study deals with all the procedures related to electronic transactions in the field of public procurement, whether at the stage of conclusion or at the stage of implementation. This will take place by presenting jurisprudence or legal opinions in this field. Starting with the UNCITRAL model laws relating to public procurement by adopting the laws and directives of the European Union until the conclusions reached by the laws of the countries. Similar to the pioneering French law in this field and certain Arab laws, as well as the rare attempts of the Algerian legislator in this field.

L'étude traite de l'ensemble des procédures liées aux transactions électroniques dans le domaine des marchés publics, que ce soit au stade de la conclusion ou au stade de la mise en œuvre, en présentant des avis jurisprudentiels ou juridiques dans ce domaine, à commencer par les lois types de la UNCITRAL relatives aux commande publics; En adoptant les lois et directives de l'Union européenne; Jusqu'aux conclusions auxquelles sont parvenues les lois des pays, similaires à la loi française pionnière dans ce domaine, et certaines lois arabes, avec mention des rares tentatives du législateur algérien dans ce domaine.
