تعدد الزوجات

Abstract

تناولت الدراسة موضوع مهم يعتبر من المواضيع التي لقت اهتمام كبيرا وجدلا واسعا بين الباحيثن والعلماء وهو موضوع تعدد الزوجات بدراسة مقارنة بين الشريعة الاسلامية وقوانين الأحوال الشخصية المغاربية، حيث اننا استنتجنا من خلال عرضنا للموضوع بطريقة تحليلة أن التعدد لم يكون وليد الصدفة او مرتبطا بالتشريع الاسلامي بل كان منذ القدم ولم تحرمه كل الأديان السماوية، كما التشريعات الحديثة تبيحه لكن وفق شروط أهمما العدل والقدر المادية بالإضافة الى المبرر الموضوعي والترخيص من الجهات القضائية واعلام الزوجين بدالك لكن التشريعات المغاربية تختلف مع التشريع الاسلامي في طريقة اثبات القدرة المادية.

The study dealt with an important topic that is considered one of the topics that have received great attention and wide debate between researchers and scholars, which is the issue of polygamy, by comparing Islamic law and Maghreb personal status laws, as we concluded through our presentation of the topic in an analytical way that polygamy was not a result of chance or related to Islamic legislation. It has been since ancient times and has not been forbidden by all divine religions, just as modern legislation permits it, but according to conditions most importantly, justice and material destiny, in addition to objective justification and licensing from the judicial authorities and informing the spouses in this way.
