حقوق التضامن في الشريعة والقانون

Abstract

حقوق الإنسان قبل أن تبلغ ما بلغته من تطور تشريعي قد مرت بمراحل تتلخص في ثلاثة أجيال، أولها جيل الحقوق المدنية والسياسية، وثانيها جيل الحقوق الاقتصادية والاجتماعية والثقافية، وثالثها جيل ما بات يعرف بحقوق التضامن، وهو موضوع بحث هذه الرسالة. فما المقصود بحقوق التضامن؟ وما هي الحقوق المندرجة تحتها؟ وما هي أسسها القانونية والشرعية؟ هي جملة إشكالات تمت الاجابة عنها عبر منهج تحليلي مقارن بين القانون الدولي لحقوق الإنسان والفقه الإسلامي. وقد تم تقسيم الدراسة إلى مدخل وثلاثة فصول رئيسية. حيث تم تخصيص المدخل للتعريف بمصطلحات البحث، بينما خصصت الفصول الرئيسية لدراسة حقوق التضامن الثلاثة وهي التنمية، البيئة، والسلم. وقد اختتم البحث بخاتمة تضمنت أهم النتائج والتوصيات المتوصل إليها من البحث.

human rights, before reaching their legislative development, passed through stages that can be summed up in three generations, the first of which is the generation of civil and political rights, the second is the generation of economic, social and cultural rights, and the third is a generation that has come to be known as solidarity rights, which is the subject of this thesis. What is meant by solidarity rights? What are the rights under it? What are its legal and legitimate foundations?. These are a number of problems that have been answered through an analytical and comparative approach between international human rights law and Islamic jurisprudence. The study has been divided into an introduction and three main chapters. Where the entrance is devoted to introducing the search terms, while the main chapters are devoted to studying the three rights of solidarity which are development, environment, and peace. The research was concluded with a conclusion that included the most important findings and recommendations reached from the research.
