Abstract

أذهلنا، ولا يزال العقل البشري يبهرنا بما بلغه من ابتكار وتكنولوجيا، و ما يعيشه العالم اليوم من تطور باهر وثورة رقمية واسعة في مجال التعاملات والاتصالات الإلكترونية، حيث أضحت الوسائل الإلكترونية مادة أصيلة في مجال الاتصالات والمعاملات، ومن نتاج هذه النهضة العلمية ظهور عدة وسائل اتصال إلكترونية ساهمت في حدوث طفرة نوعية، بانتقال المعاملات والعقود من الطرق التقليدية إلى طرق أكثر حداثة وإنتاجية واقتصاد في الوقت والتكاليف. ويعتبر الإنترنت من أهم الوسائل الإلكترونية، فبات الأفراد والمؤسسات تجار أو مدنيين يستعملون هذه الوسيلة لتلبية حاجاتهم الاقتصادية، فأضحت المعاملات والعقود التجارية تبرم عن بعد دون عائق مهما بعد موطن الأطراف، لذا وككل العقود والتصرفات القانونية، تولد العقود الإلكترونية حقوق والتزامات متقابلة في كلا جانبي العلاقة، وإثباتها يستوجب وسائل تتناسب وتتوافق مع بيئة إبرامها، لذا كان التوقيع الإلكتروني والمحرر والسجل الإلكتروني أهم وسائل الإثبات في هذا المجال.

Electronic means have become an original material in communications and transactions, the result of this scientific renaissance is the emergence of many electronic means of communication that have contributed to a quantum leap in the field of commercial contracts, with the transfer of transactions and contracts from traditional methods to more modern methods while saving time and cost. The Internet is one of the most important electronic means used by individuals, institutions, traders and civilians alike to meet their economic needs. Commercial transactions and contracts are concluded without any hindrance, despite the location of the parties, as in all contracts and legal transactions, electronic contracts generate similar rights and obligations on both sides of the relationship, and verification requires an environment-friendly means of concluding and complying with them. Therefore, the electronic signature, the editor and the electronic record were the most important means of proof in this field.
