النظام القانوني لنفايات الطبية في التشريع الجزائري والمقارن

Abstract

تنتج المرافق الصحية جراء أنشطتها اليومية العديد من القمامة والمخلفات التي يختلف حجمها حسب نوع المرفق ونوع الرعاية الصحية المقدمة من طرفه، وان كان أغلب هذه النفايات عادية شبيهة بالنفايات المنزلية التي لا تشكل أية خطورة، إلا أن بعضها الآخر أو القليل المتبقي منها يشكل خطراً حقيقياً يهدد البيئة والصحة العامة على السواء. فبالرغم من وجود الكثير من القوانين التي تحكم نقل وتسيير وإدارة النفايات الطبية الخطرة، إلا أن العديد من المخالفات المرتكبة أثناء التخلص من هذه الأخيرة لا تزال السبب الرئيس في الإضرار بالإنسان وتلوث البيئة التي يعيش فيها، إن كانت ماءً أو هواءً أو تربةً. من أجل ذلك، تستوجب النفايات الطبية اهتماماً كبيراً لمعالجتها والتخلص منها تفادياً للعديد من الأخطار التي يمكن أن يسببها التسيير السيء لهذه النفايات... وعليه جاءت هذه الرسالة للتطرق إلى أنواع النفايات الطبية ومخاطرها، طرق تسييرها، المسؤولية عن أضرارها والتعويض عنها.

As a result of their daily activities, health facilities produce many garbage and waste, the size of which varies according to the type of health care providded by it, al though most of these wastes are ordinary, similar to house hold waste that does not pose any danger but a few or the rest of them pose a real danger to the environnement and public health alike. Al though there are many laws governing the transport and management of hazardous médical waste, many violations committed during the disposal of the latter are still the main cause of harm to humans and pollution of the environnement in which they live, wherther water, air or soil. For this reason, medical waste requires great attention to its treatment and disposal in order to avoid many of dangers that can be caused by the poor management of this waste. Accordingly, this letter came to address the types of medical waste and its risks, methods of management, responsability for damages and compensation.
