الاجتهاد الذرائعي وعلاقته بالاجتهاد المقاصدي

Abstract

تناولت الأطروحة الاجتهاد الذرائعي وعلاقته بالاجتهاد المقاصدي، دراسة تأصيلية، وقد خلص البحث إلى أن الاجتهاد الذرائعي مسلك من مسالك الاجتهاد المقاصدي، ولا يرقى لأن يكون اجتهادًا خاصًا قائمًا بذاته. كما تبيَّن أن العلاقة بين الاجتهادين: الذرائعي والمقاصدي، قائمة على: تقوية مقصود الشارع وتأكيده، وإبعاد الخلل عنه. بِتجسيد أحكام الشريعة على أرض الواقع، وربط أفعال المكلفين بمقاصد الشريعة. أساس هذه العلاقة: توثيق المصلحة، ومبادئها: مبدأ السببية، الذي هو أساس معرفة المصالح والمقاصد الشرعية انطلاقًا من أن الأحكام الشرعية أسباب للمصالح، والمتفرع عنه مبدأ الغائية رعاية لتلك المصالح والمقاصد في الاجتهاد انطلاقًا من أن المصالح والمقاصد غايات للأحكام الشرعية، وهذا لتحقيق مبدأ عدم التناقض. أما أبعاد العلاقة بين الاجتهادين فتتمثل في: حفظ مقصود الشارع، بإبعاد الفساد توقعًا ووقوعًا؛ أي البعد العلاجي والوقائي، وبتأكيد وتوثيق مقصود الشارع؛ أي البعد التجديدي، تحقيقًا لبعد العدل.

This thesis deals with pretextual thinking and its relationship with higher aim thinking in an authenticating study. The research concluded that the former is part of the latter، and it cannot be promoted to a special thinking standing on itself. The thesis also shows that adding thinking to the pretexts is considered from seeking permission because thinking in Shari’a is a goal oriented thinking، and considering means brought what leads to the ends. The thinker does not look at the means and pretexts isolated from their ends، especially، that the pretexts are considered as thinking by opinion without a text. The study shows that considering pretexts within a higher aim view ensure the link of the responsible’ deeds to higher aims of Shari’a preserving the intentions of the legislator، and achieving the principle of justice.
