دور الأقطاب الجزائية المتخصصة في مكافحة الفساد

Abstract

التخصص في مجال القضاء له أهمية بالغة الأثر ودور فعال في إعطاء صبغة وبصمة قضائية على العمل القضائي،ولنظام التخصص جانبين وهما جانب تخصص القضاء وتخصص الجهات القضائية، وهو من التوجهات الحديثة والبارزة للتنظيم القضائي الجزائري، وهو الأمر الذي استحدثه المشرع الجزائري بما يسمى الأقطاب الجزائية المتخصصة، والتي عمد إلى توسيع اختصاصها المحلي وحصر اختصاصها النوعي في مسائل قضائية لجرائم ذات خطورة واثر بالغ على الجانب الاجتماعي والاقتصادي والسياسي لتطور وتسارع أحداثها، فقام المشرع بالتصدي لهاتة الجرائم من خلال تعديل قانون الإجراءات الجزائية والتنظيم القضائي، وسن قانون 06-01 المتعلق بالوقاية من الفساد و مكافحته المعدل و المتمم. تأخذ طرق البحث والتحري التي تختص بها الأقطاب الجزائية المتخصصة أساليب استثنائية لتحري عن الجرائم، خاصة أساليب التحري الحديثة ، وتمديد التوقيف للنظر، وكذا طرق اتصال الأقطاب الجزائية بالدعوى، والتحقيق القضائي الذي قد يتولاه قاضي واحد أو أكثر، إضافة إلى تمديد فترة الحبس المؤقت في الجرائم التي تختص بها الأقطاب، وفيما يخص مرحلة أثناء وبعد المحاكمة فهي تتعلق بأهم المبادئ التي تحكم الأقطاب الجزائية المتخصصة لضمان محاكمة عادلة وفقا ما ينص عليه القانون بإتباع مجموعة من إجراءات إحالة ملف الدعوى الجزائية إلى هيئة الحكم ذات تشكيلة فردية والتي يتم مناقشتها علنية وشفافية بحضور الخصوم ، وتطبيقا لمبدأ التقاضي على درجتين خول القانون لكل منهم استئناف الأحكام على مستوى الغرفة الجزائية للمجلس الذي يوجد في مقر المحكمة (القطب الجزائي المتخصص ).
