دور المحكمة الدستورية في تفسير القاعدة الدستورية

Abstract

إن المؤسس الدستوري الجزائري لم يقم في جميع الدساتير والتعديلات السابقة التي أقرت الرقابة الدستورية بالنص على وظيفة التفسير في اختصاصات المجلس الدستوري إلا أنه استعمل هذه الآلية عديد المرات في قراراته ،إلى أن جاء التعديل الدستوري سنة 2020 والذي كرس لأول مرة وبمقتضى المادة 192 منه مسألة التفسير القاعدة الدستورية كاختصاص أصيل للمحكمة الدستورية لما له من أهمية في إزالة الغموض الذي يشوب القواعد الدستورية وبالتالي ضمان التطبيق السوي والسليم لها والمساهمة في تعزيز وضمان حماية الدستور.

The constitutional rule as an inherent competence of the Constitutional Court because of its importance in removing the ambiguity that taints the constitutional rules and thus ensuring the proper and proper application of them and contributing to the promotion and guarantee of the protection of the constitution.
