حماية المتعاقد من الشروط التعسفية في الشريعة الإسلامية والقانون الجزائري

Abstract

من خلال الدراسة التي قمنا بها في هذا العمل نستخلص أن الشروط التعسفية ليست وليدة عصرنا الحالي إلا أن استفحلت في ظل انتشار المعاملات المالية المعاصرة والتي كثر فيها التعسف من قبل المتعقدين مما يوجب التصدي لها سواء كان ذلك ببطلانها أو الجزاء المترتب عليها وذلك في كل من الشريعة الاسلامية والقانون الجزائري خاصة ما ورد في القانون 04-02 الذي يحدد القواعد المطبقة على المعاملات التجارية والمرسوم التنفيذي 06-306 والذي يحدد القواعد المطبقة على المعاملات التجارية

Through the study that we carried out in this work, we conclude that the arbitrary conditions are not a product of our current era, but have become exacerbated in the light of the spread of contemporary financial transactions, in which there is a lot of abuse on the part of the contracting parties, which necessitates addressing them, whether by nullifying them or the penalty ensuing from them, and that is in both Sharia. Islamic law and Algerian law, especially what is stated in Law 02-04, which defines the rules applicable to commercial transactions, and Executive Decree 06-306, which defines the rules applicable to commercial transactions.
