Abstract

تنولنا في دراستنا بحثا مقارناً لمفهوم الإجماع عند القدامى و المحدثين فتوصلنا إلى: أن مدرسة المنارمدرسة حديثة قادها جمال الدين الافغاني ومحمد عبده ولها رواد كمحمد رشد رضا.. وغيرهفقد نشأت وتشكلت لمواجهة الاستبداد والعمل على الاصلاح الديني وعمدت على فكر احياء العقل و التجديد واليقظة ونبذ الجمود، وإبقاء الدين الاسلامي بقيمه وعقائدهأن تعريف الإجماع عند القدامى الذي هو:اتفاق المجتهدين بعد وفاة النبي صلى الله عليه وسلم في عصر من العصور على حكم شرعي. فهم يقولون بإمكانية وقوعه، خلاف رواد مدرسة المنار فمنهم من قال انه يتصور فقط ولا يمكن انعقاده مثل أبو زهرة ومنهم من قال انه يتصور وممكن وقوعهمحمد عبدهوذلك لشروط اعتبروها عندهم، كما اضافوا أن الإجماع يقوم على اساس التشاور من طرف مجتهدين مختصين بالبحث والنظر معينين من قبل السلطة

In our study we condacted a comparative study of thconcept ofcnsensus among the ancients and mderns and we came to the following conclusins that Al-Manar school was led by Jamal Al-Din Al-Afghani and Muhammad Abdou and it had pioneers Like Muhammad Rashid Rida, and othe, it arose and was formed to confront tyranny and work on religious reform. It relied on the thought of reviving reason, renewal, vigilance, renunciation of stagnation, and preserving the Islamic religion with its values and beliefs. Era of the ages on the rule of law. All of them say that it can happen, unlike the pioneers of the Al-Manar school, some of them said that it is only imagined and cannot be held, like Abu Zahra, and some of them said that it is imagined and possible, such as Muhammad Abdou, this is for conditions they considered them, and they also added that the consensus is based on the basis of consultation by specialized mujtahids.
