آليات تفويض المرفق العام بالجماعات المحلية في التشريع الجزائري

Abstract

جسد المشرع الج ا زئري دور أشخاص القانون الخاص في مجال تسییر المرفق العمومي من خلال إصدار نصوص قانونیة مستحدثة في النظام القانوني، تتعلق بتنظیم آلیات تسییر المرفق العمومي، والتي یبدو الاتجاه من خلالها إلى تفعیل الأخذ بأسل وب عقد التفویض مع أشخاص القانون الخاص كنمط مواكب للتطو ا رت. هذه المقاربة لم تكن محل إهتمام السلطات العمومیة ولا حتى من قبل الباحثین والدارسین خاصة فیما یتعلق بتسییر المرفق العمومي المحلي عكس المرفق العمومي على المستوى الوطني الذي لقي اهتماما كبی ا ر، بالرغم من أن تحقیق الأهداف المنشودة خاصة فیما یتعلق بتحسین إدارة الم ا رفق العامة یتطلب إلى جانب الإدارة المركزیة وجود إدارة محلیة فعالة وعالیة الأداء.

The Algerian legislator embodied the role of private law persons in the field of the managing the public service by issuing the new legal texts in the legal system, related to the regulation of the public service management mechanisms, through which it tends to activate the adoption of the delegation contract with persons governed by private law as a pattern that keeps pace with developments. This approach did not interest the public authorities, not even researchers and academics, particularly as regards the management of the local public service, unlike the public service at national level, which has been the subject of great attention, although that achieving the desired objectives, particularly in terms of improving the management of public services, requires, in addition to the central administration, the existence of an efficient and effective local administration.
